1. Use of Services

Your Registration Obligations

When you register to use the Services, you agree to provide accurate and complete information about yourself. If you are under 13 years old, or if you are under 16 years old and are a citizen or resident of the European Economic Area (EEA) or the United Kingdom (UK), do not register for the Services—you are not authorized to use them.

Member Account, Password, and Security

You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur using your password or account. You agree to immediately notify aistory.world of any unauthorized use of your password or account or any other breach of security, and ensure that you log out from your account at the end of each session when accessing the Services. aistory.world will not be liable for any loss or damage arising from your failure to comply with this provision.

General Practices Regarding Use and Storage

You acknowledge that aistory.world may establish general practices and limits concerning use of the Services. These may include the maximum period of time that data or other content will be retained, and the maximum storage space allotted on aistory.world servers. You agree that aistory.world has no responsibility for the deletion or failure to store any data. You acknowledge that aistory.world reserves the right to terminate accounts that are inactive for an extended period of time, and to change these general practices and limits at any time, with or without notice.

Email Notifications

You agree to receive electronic communications from us. These may relate to your account, service changes, or other updates or marketing information related to the Services.

2. Terms of Use

User Conduct

In addition to agreeing to comply with our Community Guidelines, you agree not to submit content that:

• Infringes intellectual property rights
• Contains malware or harmful code
• Poses privacy or security risks
• Is threatening, abusive, harassing, or bullying
• Is excessively violent or graphic
• Constitutes hate speech or promotes discrimination
• Is obscene, pornographic, or constitutes sexual harassment
• Involves sexual exploitation or abuse of minors
• Glorifies self-harm, suicide, or eating disorders
• Promotes terrorism or criminal activity
• Attempts to provide medical, legal, or financial advice
• Interferes with or disrupts the Services

You also agree not to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Harvest user information
• Attempt unauthorized access
• Reverse engineer the Services

Content Moderation

We reserve the right to investigate and take appropriate action against violations, including content removal, account suspension, and reporting to authorities. We use automated and manual measures to identify problematic content.

3. Intellectual Property

Your Submitted Content

When you submit content to the Services, you represent that you own all rights to that content or have obtained all necessary permissions. You retain ownership of your content but grant aistory.world a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and distribute your content for any purpose related to aistory.world.

Generated Content

When you use the Services to generate content (such as character stories, dialogues, images), you and aistory.world jointly own that generated content. You grant aistory.world the same broad license described above for all generated content.

Service Content and Trademarks

The Services contain content protected by copyright, patent, trademark, trade secret, and other laws. You may not engage in data mining, scraping, or similar automated data collection methods. The aistory.world name and logo are trademarks of aistory.world. No rights to use these trademarks are granted except as expressly provided in these Terms.

Third-Party Content

aistory.world is not responsible for any third-party content, including user-created characters and AI-generated content. AI-generated content is inherently unpredictable and may produce inaccurate or offensive output. You acknowledge that you must evaluate and bear all risks associated with using any content.

4. Copyright Complaints

aistory.world respects intellectual property rights. If you believe your work has been copied in a way that constitutes copyright infringement, you may submit a DMCA notice via email to us.

To be effective, the notice must be in writing and contain:

• Electronic or physical signature of the copyright owner or authorized person
• Description of the copyrighted work claimed to have been infringed
• Description of where the infringing material is located on the Services
• Your contact information
• Statement that you have a good faith belief the use is not authorized
• Statement that the information in the notice is accurate

We have a policy of terminating accounts of repeat infringers in appropriate circumstances.

5. Third-Party Websites and Services

The Services may contain links to third-party websites or applications. aistory.world has no control over and assumes no responsibility for such external sites or resources. Any dealings you have with third parties are solely between you and such third party.

6. Paid Accounts

Billing

If you purchase any Services, you must provide complete and accurate billing information including a valid payment method. For paid subscriptions, we will automatically charge your payment method on each agreed-upon periodic renewal until you cancel. You are responsible for all applicable taxes.

Cancellation

You may cancel a paid subscription at any time. Except as required by law, payments are non-refundable.

Price Changes

We may change prices from time to time. If we increase subscription prices, we will provide at least 30 days advance notice, and any price increase will take effect on your next renewal.

7. Indemnification and Disclaimers

You agree to indemnify and hold harmless aistory.world and its affiliates, officers, employees, directors, and agents from any and all losses, damages, and expenses arising from or related to your use of the Services, including reasonable attorneys' fees.

Disclaimers

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. aistory.world expressly disclaims all warranties of any kind, whether express, implied or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

8. Limitation of Liability

You understand and agree that aistory.world shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, goodwill, use, data, or other intangible losses, resulting from:

• Your use or inability to use the Services
• Your access to, use of, creation of, or interaction with any content
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on the Services
• Any other matter related to the Services

In no event shall aistory.world's total liability to you for all damages, losses, or causes of action exceed the greater of: (i) $100; or (ii) the amount you have paid to aistory.world for use of the Services, if any.

9. Resolving Disputes Through Binding Arbitration

Arbitration Agreement

You and aistory.world agree that any and all disputes or claims shall be resolved through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. JAMS will administer the arbitration under the JAMS Streamlined Arbitration Rules and Procedures.

Waiver of Jury Trial and Class Action Rights

You and aistory.world agree that by entering into these Terms, you and aistory.world are each waiving the right to a trial by jury or to participate in a class action. Your rights will be determined by a neutral arbitrator, not a judge or jury.

How to Opt Out

If you do not wish to be bound by the arbitration agreement, you must notify aistory.world in writing via email (sent to aistorypro.world@gmail.com) within 30 days of the date you first agreed to these Terms, stating that you do not wish to resolve disputes with aistory.world through arbitration. Opting out of the arbitration agreement will not affect any other part of these Terms.

Pre-Arbitration Dispute Resolution Process

aistory.world is always committed to resolving disputes amicably and fairly. If you have any concerns, we strongly encourage you to first contact us at aistorypro.world@gmail.com. You and aistory.world agree to attempt to resolve any claim informally for 60 calendar days before initiating arbitration.

Small Claims

Either you or aistory.world may bring an individual action in small claims court seeking individual (non-class) relief, provided that the action is not transferred or appealed to a court of general jurisdiction or federal jurisdiction.

10. Termination

You agree that aistory.world may, in its sole discretion, suspend or terminate your account (or any part thereof) or your use of the Services and remove and discard any content within the Services for any reason, including, without limitation, for lack of use or if aistory.world believes that you have violated or acted inconsistently with the letter or spirit of these Terms.

You agree that aistory.world shall not be liable to you or any third party for any termination of your access to the Services. Termination of your account or your access to any component of the Services will not terminate aistory.world's rights to your content.

11. General

Entire Agreement

These Terms constitute the entire agreement between you and aistory.world and govern your use of our Services, superseding any prior agreements between you and aistory.world with respect to the Services.

Governing Law, Jurisdiction, and Venue

If you are not a consumer in the European Economic Area, these Terms shall be governed by the laws of California, without regard to its conflict of law provisions. For any dispute or claim not subject to arbitration described above, you and aistory.world agree to submit to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California.

Severability

If any provision of these Terms is found to be invalid by a court of competent jurisdiction, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

No Waiver

The failure of aistory.world to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Statute of Limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or these Terms must be filed within one year after such claim or cause of action arose or be forever barred.

Assignment

You may not assign these Terms without the prior written approval of aistory.world, but aistory.world may assign these Terms in whole or in part without restriction.

Notices

We will send you notices by email or by posting on the Services. You agree to provide aistory.world with a valid email address, to check your email regularly for messages from aistory.world, and to provide aistory.world with an updated email address if your previously provided email address is unable to receive email.

12. Changes to These Terms

We reserve the right, at our sole discretion, to change or modify portions of these Terms at any time. If we do this, we will post the changes on this page and will indicate at the top of the page the date these Terms were last revised. Significant changes will become effective at least 30 days after posting, except changes to new features of the Services or changes made for legal reasons which will be effective immediately.

Your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new Terms.
